Terms of Service

1. Acceptance of Terms

By creating an account or using RSVPay ("the App"), you agree to these Terms of Service. If you do not agree, do not use the App. You must be at least 18 years old and a legal resident of the United States to use RSVPay. The App is only available in the United States and supports US dollars (USD) only.

2. About RSVPay

RSVPay is a platform that enables users to organize group events and collect payments from attendees. RSVPay facilitates connections between event organizers and attendees but is not a party to any transaction between users. RSVPay does not organize, host, or guarantee the quality, safety, or occurrence of any event.

3. Accounts

You are responsible for maintaining the security of your account credentials. You must provide accurate information when creating your account. You may not create accounts for others or transfer your account. RSVPay reserves the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

4. Payments and Fees

Attendees pay for events individually by card or supported digital wallets (such as Apple Pay). All payment processing is handled by our payment processor, Stripe. RSVPay does not hold your funds in its own bank accounts.

When your card is charged: When you RSVP to a paid event, your card is normally charged straight away. There are two exceptions, and in both of them your payment method is saved securely with Stripe and is NOT charged at that time: (a) the organizer has set a lock-in date for the event, in which case your card is charged on that date; or (b) the event is more than 90 days away, in which case your card is charged 90 days before it starts. Whichever applies, the charge happens automatically and without further action from you. The amount and the charge date are shown for you to review before you confirm, and you authorize RSVPay to charge that payment method for that amount at that time. RSVPay does not charge any card more than 90 days before the event it is for.

If a charge fails: If your card is declined when we attempt the charge, we will notify you and retry, and you can update your payment method in the App. Your spot is held while we retry. If we are unable to charge your payment method by approximately 12 hours before the event starts, your reservation is canceled, your spot is released (which may be offered to someone on the waitlist), and you will not be charged or entitled to attend.

Fees: When you pay for an event, your card is charged exactly the ticket price set by the organizer — no fees are added at checkout. A service fee is included within the ticket price: it consists of a platform fee of 1.5% of the price plus $0.20 per ticket, which goes to RSVPay and covers the cost of running the service, and a card processing fee (currently 2.9% + $0.30, calculated on the charge), which covers the cost charged by our payment processor. The organizer receives the ticket price minus the service fee. The refundable amount — the ticket price minus the included service fee — is shown for you to review before you confirm. Processing rates are set by the processor and may change; the rates in effect when your card is charged are the ones that apply.

Holding period: Once charged, event payments are held by our payment processor (Stripe) on RSVPay's platform balance. The organizer's portion is released to their in-app balance within 3 business days of the event, and usually within about 12 hours of its scheduled start time. This holding period allows the refundable amount to be returned if the event is canceled or does not meet its minimum attendance.

Organizer payouts: Organizers receive their event earnings (the ticket price minus the included service fee) into an in-app balance after each event ends and may withdraw that balance to a linked bank account. Standard withdrawals are free and typically take 1-3 business days. Instant withdrawals are available for a fee of 1% of the amount transferred and arrive within minutes. A payout account fee of $2.00 applies to your first withdrawal in each calendar month; this covers the monthly charge our payment processor makes for maintaining your payout account, and it is not charged in months when you do not withdraw. All fees are deducted from the amount you request, and the exact amount you will receive is shown for you to review before you confirm a withdrawal. You authorize RSVPay to collect these fees by debiting the balance of your connected payout account. Partial withdrawals must be at least $10.00; you can withdraw your full available balance at any amount. Funds still being held for upcoming events are not available for withdrawal until they are released.

5. Refunds and Cancellations

Canceling before you are charged: If you have reserved a spot and your card has not been charged yet, you may cancel at any time at no cost. Nothing is charged, no fee is retained, and your spot is released to the event.

Canceling after you are charged: Once your card has been charged, canceling your RSVP before the event's refund cutoff returns the refundable amount shown at checkout. The included service fee is not refundable. After the refund cutoff, payments are non-refundable and canceling frees your spot without a refund.

Organizer cancellation: If an organizer cancels an event, attendees who have not yet been charged have their reservations canceled and are not charged at all. Attendees who have already been charged are returned the refundable amount shown at checkout. The included service fee is not refundable.

Minimum attendance: Some events require a minimum number of attendees by a set deadline. Reserved spots count toward that minimum. If an event does not meet its minimum by that deadline, the event is canceled: reservations that have not been charged are canceled at no cost, and attendees who have already been charged are returned the refundable amount shown at checkout.

Refund cutoff: Organizers set a refund cutoff for their paid events — a point after which payments are no longer refundable. The cutoff cannot fall earlier than the time cards are charged for that event, and an organizer may choose to make payments non-refundable as soon as they are charged. If an organizer does not set a cutoff, refunds close 2 hours before the event's start time. Separately, an organizer may choose to issue a refund to an individual attendee at any time, including after the cutoff has passed; service fees are not returned. The refund terms that apply to your payment are shown for you to review before you confirm.

Refund destination: Refunds are returned to your original payment method. Depending on your card issuer, a refund may take 5-10 business days to appear on your statement.

Disputes between organizers and attendees should be resolved directly between the parties. RSVPay may assist in dispute resolution at its discretion but is not obligated to do so.

Card disputes: If you do not recognize a charge, or you believe something went wrong with an event, please contact the organizer or email support@rsvpay.io before disputing the charge with your bank — we can usually resolve it faster. Charges appear on your statement as “RSVPAY” followed by the event name.

If you dispute a charge with your card issuer, the disputed amount is recovered from the organizer who received it, including from their future payouts if their balance does not cover it. RSVPay may provide your card issuer and the organizer with records of your participation — such as your RSVP, check-in, and activity in the event’s chat — as evidence.

Whether an event took place, and whether it met your expectations, is a matter between you and the organizer. RSVPay processes payments and provides the tools; it does not vet organizers and does not guarantee that an event will occur or will be as described.

6. Event Organizer Responsibilities

RSVPay is built for events among people who know one another. When someone pays for your event, they are trusting you to deliver it. That trust is the core of how RSVPay works.

If you create a paid event, you are responsible for delivering the event as described. You must set up a Stripe Connect account to receive payouts. Organizers who collect payments and fail to deliver events may have their accounts suspended and may be subject to chargebacks.

Organizers are responsible for complying with all applicable laws related to their events, including obtaining any necessary permits or insurance.

Tax reporting: Organizers who receive payments may be issued tax forms (such as a 1099-K) by our payment processor in accordance with applicable reporting thresholds. You are responsible for any taxes owed on payments you receive.

Chargebacks on your events: If an attendee disputes a payment for your event with their card issuer, the disputed amount is recovered from you — from your available balance, or from future payouts if your balance does not cover it, which may leave your balance negative until it is repaid. You are responsible for responding with evidence that the event took place. Repeated disputes may result in your account being restricted.

RSVPay includes automated content filtering to prevent inappropriate language. Users may report other users for policy violations. RSVPay reserves the right to review reports and take action including content removal, account suspension, or account termination.

9. Account Deletion

You may delete your account at any time from the Settings page. Account deletion is permanent and will remove your profile, group memberships, event history, and transaction records. You must withdraw any remaining wallet balance before deleting your account. Accounts with pending paid events may not be deleted until those events are resolved. Deleting your account also cancels any spots you have reserved but not yet been charged for.

RSVPay is provided "as is" without warranties of any kind. RSVPay is not responsible for:

To the maximum extent permitted by law, RSVPay's total liability shall not exceed the amount of fees you have paid to RSVPay in the twelve months preceding any claim.

11. Changes to Terms

RSVPay may update these Terms of Service at any time. Continued use of the App after changes constitutes acceptance of the updated terms. We will notify users of material changes through the App.
