Terms of Service

1. Acceptance of Terms

By creating an account or using RSVPay ("the App"), you agree to these Terms of Service. If you do not agree, do not use the App. You must be at least 18 years old and a legal resident of the United States to use RSVPay. The App is only available in the United States and supports US dollars (USD) only.

2. About RSVPay

RSVPay is a platform that enables users to organize group events and collect payments from attendees. RSVPay facilitates connections between event organizers and attendees but is not a party to any transaction between users. RSVPay does not organize, host, or guarantee the quality, safety, or occurrence of any event.

3. Accounts

You are responsible for maintaining the security of your account credentials. You must provide accurate information when creating your account. You may not create accounts for others or transfer your account. RSVPay reserves the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

4. Wallet and Payments

RSVPay provides an in-app wallet for making and receiving event payments. All funds are held within the systems of our payment processor, Stripe. Money you add to your wallet is held in a Stripe account associated with you. RSVPay does not hold your funds in its own bank accounts.

Deposits: You may fund your wallet via linked bank account (ACH). A processing fee of 0.8% (capped at $5.00) applies to ACH deposits. ACH deposits typically take a few business days to clear before the funds become available in your wallet.

Card payments: You may also pay using a credit or debit card. A processing fee of 2.9% + $0.30 applies to card transactions.

Event payments: When you pay for an event from your wallet balance, the funds are held by our payment processor (Stripe) on RSVPay's platform balance and released to the organizer shortly after the event ends. This short holding period allows funds to be refunded if the event is canceled or does not meet its minimum attendance. Internal wallet transactions do not incur additional fees.

Withdrawals: You may withdraw your available wallet balance to your linked bank account. Standard withdrawals are free and typically take 1-2 business days. Instant withdrawals are available for a 1% fee (minimum $0.50) and arrive within minutes. Funds being held for upcoming events are not available for withdrawal until they are released.

RSVPay does not charge a platform fee on event payments. Fee structures are subject to change with notice.

5. Refunds and Cancellations

Attendee cancellation: If you cancel your RSVP to a paid event before the organizer's cancellation deadline, the event fee is refunded to your in-app wallet balance. Processing fees paid on your original deposit are not refundable.

Organizer cancellation: If an organizer cancels an event, all attendees receive a full refund of the event fee to their wallet balances.

Minimum attendance: Some events require a minimum number of paid attendees by a set deadline. If an event does not meet its minimum by that deadline, the event is canceled and all attendees are refunded to their wallet balances.

Cancellation deadlines: Organizers may set a cancellation deadline for their events. After this deadline, attendees may not be able to cancel their RSVP or receive a refund.

Refund destination: Refunds are returned to your in-app wallet balance, not to your original card or bank account. You may then withdraw your wallet balance to your linked bank account.

Disputes between organizers and attendees should be resolved directly between the parties. RSVPay may assist in dispute resolution at its discretion but is not obligated to do so.

6. Event Organizer Responsibilities

If you create a paid event, you are responsible for delivering the event as described. You must set up a Stripe Connect account to receive payouts. Organizers who collect payments and fail to deliver events may have their accounts suspended and may be subject to chargebacks.

Organizers are responsible for complying with all applicable laws related to their events, including obtaining any necessary permits or insurance.

Tax reporting: Organizers who receive payments may be issued tax forms (such as a 1099-K) by our payment processor in accordance with applicable reporting thresholds. You are responsible for any taxes owed on payments you receive.

RSVPay includes automated content filtering to prevent inappropriate language. Users may report other users for policy violations. RSVPay reserves the right to review reports and take action including content removal, account suspension, or account termination.

9. Account Deletion

You may delete your account at any time from the Settings page. Account deletion is permanent and will remove your profile, group memberships, event history, and transaction records. You must withdraw any remaining wallet balance before deleting your account. Accounts with pending paid events may not be deleted until those events are resolved.

10. Limitation of Liability

RSVPay is provided "as is" without warranties of any kind. RSVPay is not responsible for:

To the maximum extent permitted by law, RSVPay's total liability shall not exceed the amount of fees you have paid to RSVPay in the twelve months preceding any claim.

11. Changes to Terms

RSVPay may update these Terms of Service at any time. Continued use of the App after changes constitutes acceptance of the updated terms. We will notify users of material changes through the App.
